AGREEMENT TO TERMS

These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "user"), whether personally or on behalf of an organization, and Pacebeats ("Company," "we," "our," or "us"), governing your access to and use of the Pacebeats mobile application and any related platforms, services, or tools (collectively, the "Service").

By downloading, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree, you must immediately stop using the Service and uninstall the application.

This license does not include modifying or copying our materials, using the materials for commercial purposes, attempting to reverse engineer any software contained in Pacebeats, removing any copyright or proprietary notations, or transferring the materials to another person or mirroring the materials on any other server. This license shall automatically terminate if you violate any of these restrictions.

3. User Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. This includes creating a strong password and keeping it secure, not sharing your account credentials with others, promptly notifying us of any unauthorized access or security breaches, ensuring your account information remains accurate and up-to-date, and understanding that you are responsible for any content posted or actions taken through your account.

• You will not hold Pacebeats liable for any injuries or health issues that may occur
• You will use the app responsibly and within your physical limitations

6. Music and Content Usage

Pacebeats integrates with music streaming services to provide tempo-matched playlists. Users are responsible for having valid subscriptions to any third-party music services. We do not store or distribute copyrighted music content. All music is streamed through legitimate platforms in accordance with their respective terms of service.

7. Limitation of Liability

Pacebeats is provided "as is" and "as available." We make no warranties about the accuracy of fitness data, continuous service availability, or results from using the app. We are not liable for any damages resulting from your use of the app, including but not limited to lost data, fitness injuries, or any other direct or indirect damages.

8. Termination

We reserve the right to suspend or terminate your access to Pacebeats at any time, without notice, for conduct that violates these Terms or is otherwise harmful to our service or other users. You may also terminate your account at any time by deleting the application and contacting us to remove your data.
